This is nothing new - been happening for at least 25+ years that I personally know of - happened to me twice. USERRA is just the latest incarnation of what used to be called the Soldiers & Sailors Civil Relief Act. The laws are there to protect the reservists but as long as the courts screw around with balancing both sides of a reserve members chosen career we will have this sort of thing happen.
